A contract is considered to exist between a User and The Foundation for Family Affairs when a User’s Credit or debit card is charged, or payment is processed through another method.

If you receive a Product and it is not as it was described on the Site, your absolute remedy is to return it unused for a refund.

Payment

If we decide to grant credit, all payable sum must be paid within 30 days from the date specified on the invoice. We, however, reserve the right, in our sole discretion, to refuse to grant credit. Failure to pay by the due date will leave us with no other option than to suspend further delivery on future orders. Foundation for Family Affairs reserves the right to, at any time, in its sole discretion, demand the immediate payment of any Product and to take legal action to claim any debt and costs.

 

Delivery

Foundation for Family Affairs will deliver a Product, once order is made and payment is fully processed, within reasonable time to the delivery address you provide on your order (‘Delivery Location’). On each transaction, we will inform the Buyer of the date of delivery to the Delivery Location. If the Buyer fails to accept delivery of the Product, any Cost resulting from this, including storage cost and insurance, will be paid by the Buyer. The Buyer, at own expense, is responsible for getting import licences required for the shipment of a Product, if necessary, and will make them available to us before shipment. We will not be liable for the non-delivery of any Product to the Delivery Location, unless the Buyer provides us with a written notice of non-delivery within 5 days from the specified date of delivery. Our liability for the non-delivery of any Product will be limited to replacing the Product within reasonable time.

 

Title: Risk of Loss
The risk of loss or damage passes to the Buyer upon delivery of the Product to the carrier. If the Buyer fails to accept delivery on the date specified on the notice, or if the carrier is unable to deliver the Product to the Delivery Location on the date specified because the Buyer failed to provide adequate instructions, or authorisations, the Product will be deemed to have been delivered to the Buyer and the risk of loss will pass to the Buyer. The Buyer will be liable for costs incurred from the failure to deliver the Product, including, but not limited to, the cost of storage and insurance.

The title for all Products purchased from this Site passes to the Buyer upon delivery of the Product to the carrier.

 

Applicable Law and Jurisdiction

The Terms on this Site shall be governed exclusively by English law and Users agree that that is the applicable law to be applied in all cases. Any dispute related to the terms and conditions on this Site shall be subject to the jurisdiction of the courts of England and Wales.

 

Severability
